V5.215 Duties of Senior Accounting Officer

Part V5 Compliance, enforcement and appeals

The Senior Accounting Officer must2:

    •ÌýÌýÌýÌý Take reasonable steps to

    1. Ìý

      –ÌýÌýÌýÌý ensure that the company and each subsidiary (if any) establishes and maintains 'appropriate tax accounting arrangements', ie arrangements (including the keeping of accounting records) that enable the relevant liabilities (this can be referred to as the 'main duty')3 of the company and subsidiaries to be calculated accurately

    2. Ìý

      –ÌýÌýÌýÌý monitor the accounting arrangements of the company and each subsidiary, if any, and

    3. Ìý

      –ÌýÌýÌýÌý identify any respects in which those arrangements are not appropriate tax accounting arrangements

  3. Ìý

    •ÌýÌýÌýÌý Provide HMRC, by such means and in such form as HMRC may reasonably specify, with a certificate. (see 'Forms of certificate' below). The certificate must:

    1. Ìý

      –ÌýÌýÌýÌý state whether the company had appropriate tax accounting arrangements throughout the financial year, and

    2. Ìý

      –ÌýÌýÌýÌý if it did not, give an explanation of the respects in which the accounting arrangements were not appropriate tax accounting arrangements.
