Firstly, it is necessary to define a 'taxable person'. A taxable person is any person performing, in an independent manner, irrespective of location, economic activities such as the activities of producers and traders, service providers, mining and agricultural activities, professions or the exploitation of tangible or intangible property for the purposes of obtaining income on a continuing basis.

Individuals are not considered to perform an economic activity in the scope of VAT when obtaining income from the sale of owned dwellings or other property which was used by them for personal purposes. However, an individual will be considered a taxable person if the exploitation of tangible or intangible property is carried out in an independent manner in order to obtain income on a continuing basis. Thereafter, the individual will have the rights and the obligations with respect to VAT.

Any taxable person who establishes a business in Romania and carries out or intends to carry out an economic activity that involves taxable and/or input VAT deduction entitlement and VAT-exempted transactions must request registration
