41 Romania

Romanian VAT legislation establishes the treatment applicable to the transfer of assets or certain assets. The transfer of all assets, or part thereof, made at the time of the transfer of assets and/or liabilities, irrespective of whether it is the result of a sale or of certain operations such as demerger, merger or an in-kind contribution to the capital of a business, does not represent a supply of goods if the recipient of the assets is a taxable person.
