There may be different scenarios for individual dismissals and the right to receive a severance payment. The most common situations are objective or disciplinary dismissal. The most common situations are:
(a) Objective
The main reasons for an objective dismissal are:
- Ìý
–ÌýÌýÌýÌý workers' incompetence
- Ìý
–ÌýÌýÌýÌý worker's inability to adapt to technical change
- Ìý
–ÌýÌýÌýÌý layoffs based on economic, technical, organisational and or productivity grounds
- Ìý
–ÌýÌýÌýÌý lack of attendance at work
It must be considered that the labour courts are very restrictive in accepting these situations for an individual objective dismissal.
In case the objective dismissal is granted, then the tax free severance payment is 20 days ´salary per year of service, up to 12 months 'salary.
(b) Disciplinary dismissal
The labour regulation establishes the following situations that could entail an individual disciplinary dismissal:

–ÌýÌýÌýÌý repeated and unjustified tardiness or lack of attendance at work
- Ìý
–ÌýÌýÌýÌý lack of discipline or insubordination
- Ìý
–ÌýÌýÌýÌý verbal or physical offence towards the employer, other people working in the company or residing family
