Before posting a worker to Sweden, who is a third-country national, it is important to first check that the worker has the right to stay and to work in Sweden. All persons with a residence and work permit issued for 3 months or more hold a residence permit card (UT card), containing information about whether the permit is temporary, and if so, the period of validity.
On 1 August 2013, legislative amendments came into force under EU Directive 2009/52/EC, providing for minimum standards on sanctions and measures against employers of illegally staying third-country nationals. The term third-country national refers here to a worker posted to Sweden who is not a citizen of the EU, an EEA country, or Switzerland.
As a result of the change, a person employing a third-country national in Sweden is obliged to notify the Swedish Tax Agency
