FR1.4.2 Capital gains tax

France

European Union and Swiss residents and other non-French residents are charged to capital gains tax on the sale of the French situs assets. The gain is taxed at different rates from French residents (see FR1.5.2 Tax rates).

The following are gains from French sources (CGI, Art 164B):

    •ÌýÌýÌýÌý capital gains on the transfer for valuable consideration of property or rights of all kinds and profits derived from transactions carried out in particular by property dealers, where they relate to businesses operated in France and to properties situated in France, property rights relating to them or shares in unlisted companies whose assets mainly consist of such property and rights

  2. Ìý

    •ÌýÌýÌýÌý capital gains on the transfer of shares in companies having their registered office in France

The progressive exemption for capital gains applies (see FR1.3.2).
