SW2.1.7 Legal process for buying a property

Switzerland

After the buyer has chosen a property to buy, they should affiliate an official Swiss notary, who will act on behalf of both the purchaser and the vendor to complete the transaction.

To buy a holiday home by foreign citizens, the notary must open a procedure for obtaining an authorisation from the relevant canton to purchase that particular property. To buy a permanent residence as a foreign citizen, it is necessary to obtain a Swiss residence permit B or C (see above 'Purchasing property in Switzerland as a foreign national'). Once the authorisation or the Swiss residence permit has been received, the buyer and the seller sign the notary's deed of sale.

For buyers not wishing to travel to Switzerland to sign the deed of sale in person, they can provide power of attorney to an appointed representative, usually from the notary's office in Switzerland, who will sign the document on their behalf (for more details on the Power of Attorney, see SW3.2 'Effecting a power of
