9.1ÌýÌýÌýÌý The Fair Work system

The Fair Work system is the national workplace relations system. The Fair Work system was established by the Fair Work Act 2009 and applies to most Australian workplaces.

Broadly, the Fair Work system applies to all Australian employees with the exception of some State public sector and local government employees and, in the State of Western Australia, employees of unincorporated businesses and non-trading companies.

There are four main elements of the Fair Work system:

    •ÌýÌýÌýÌý 11 minimum National Employment Standards

  2. Ìý

    •ÌýÌýÌýÌý awards that apply nationally for specific industries and occupations

  3. Ìý

    •ÌýÌýÌýÌý a national minimum wage (AUD 915.90 per week or AUD 24.10 per hour from 1 July 2024)

  4. Ìý

    •ÌýÌýÌýÌý unfair dismissal protections

A non-resident remote worker may be subject to the fair work system (Gautam Parimoo v Lake Resources NL (C-2023/479)).
