3.4.5 Parental leave and payments

New Zealand

The amount of leave an employee may be entitled to and who may take the leave is dependent on each parent or partner's service history. These are referred to in Parental Leave and Employment Protection Act 1987, s 2BAv, as being the:

  1. Ìý

    •ÌýÌýÌýÌý 6-month employment test – the employee must have been employed by the same employer for at least an average of ten hours per week in the six months immediately prior to, or

  2. Ìý

    •ÌýÌýÌýÌý 12-month employment test – the employee must have been employed by the same employer for at least an average of ten hours per week in the 12 months immediately prior to:

      –ÌýÌýÌýÌý the expected date of birth of the child, or

    2. Ìý

      –ÌýÌýÌýÌý the date the employee assumes responsibility for the care of the child

Where both the mother (or primary carer) and their partner satisfy the 12-month employment test, the following applies:
