9.1 Employment law overview

New Zealand

Employment Relations Act 2000 sets out the legislative framework within which the relationship between employer and employee should be conducted. An important cornerstone of the Act is to promote 'good faith' in all undertakings within this relationship, and so recurs throughout the content.

Employment New Zealand is part of the Ministry of Business, Innovation and Employment and is the leading source of information on employment in New Zealand.

In 2022, New Zealand saw the introduction of Fair Pay Agreement Act 2022, which received Royal Assent on 1 November 2022. Its purpose was to improve employment terms by providing:

  1. Ìý

    •ÌýÌýÌýÌý a framework for bargaining for fair pay agreements that specify industry or occupation-wide minimum employment terms, or

  2. Ìý

    •ÌýÌýÌýÌý in certain circumstances, for the Authority to determine those minimum employment terms,

with all relevant parties applying the duty of good faith and related obligations, to the proceedings.

Repeal of Fair Pay Agreement Act 2022

The current coalition government between the National Party and the ACT committed to repeal the Fair Pay Agreement Act 2022
