8.8 Criminal penalties

The federal government has broad discretion in its ability to treat employment tax enforcement cases with civil or criminal judicial action. Three IRC sections potentially apply.

IRC §6672(a) imposes a 100% civil penalty on responsible persons who fail to withhold and/or pay over employment taxes.

IRC §7202 makes a wilful failure to collect and pay tax for employment
