B6.571 ATED relief—property traders

Business tax

This article discusses the relief from ATED which is available to property traders holding an SDI for sale. For the effect of ATED reliefs, see B6.745.

A day in a chargeable period is eligible for relief if on that day1:

  1. Ìý

    •ÌýÌýÌýÌý a person carrying on a property trading business is entitled to the interest

  2. Ìý

    •ÌýÌýÌýÌý the interest is held as stock for the sole purpose of resale in the course of the business, and

  3. Ìý

    •ÌýÌýÌýÌý a non-qualifying individual (defined as for the rules described in B6.746) is not permitted to occupy it2. Occupation of any part of a dwelling is regarded as occupation of the dwelling3. See below for the look forward and look back effect of non-qualifying occupation

'Property trading business' means a business that4:

  1. Ìý

    •ÌýÌýÌýÌý consists of or includes activities in the nature of a trade of buying and selling dwellings, and
