Given the requirement to calculate the deemed employment payment, it may be sensible not to pay dividends but simply to calculate the deemed payment instead. However, there are likely going to be situations where a dividend payment has already been made on the basis that the company was not an MSC and so the issue of double taxation will need to be addressed.
