18 Joint bank accounts

| Commentary

Where two parties (commonly but not necessarily spouses) open a joint banking account on the terms that either may draw on the account, then, unless there is some agreement to the contrary, either may during their joint lives draw on the account for their own purposes which, it is thought, must include making a gift1. Prima facie if the account is closed the parties will be equally entitled to the closing balance2.
