What is the procedure to remove a caveat?

A Caveat is effective for six months. It can be extended on an ongoing basis for six months at a time. If the caveat is not renewed it will expire and any interested party is free to extract a grant.

Withdrawal of caveat

A caveat can be withdrawn at any time before entering an Appearance by the Caveator writing to the district Probate registry at which the caveat was entered. The caveator must give notice of the withdrawal to anyone who has warned the caveat.

Warning and appearance

If those propounding the Will believe there is no real reason for preventing a grant, they may enter a warning to the caveat. The procedure for warning a caveat is dealt with under Non-Contentious Probate Rules 1987, SI 1987/2024,
