This Practice Note provides guidance on the interpretation and application of the relevant provisions of the CPR. Depending on the court in which your matter is proceeding, you may also need to be mindful of additional provisions—see further: Court specific guidance.

Amendments to CPR 8 procedure from 1 October 2022

On 1 October 2022, amends were made to the CPR which affect the CPR 8 procedure.

The most significant change was the removal of practice direction 8A, which was replaced by CPR PD 49E. CPR PD 49E retained the majority of the provisions of practice direction 8A, but section A was cut back and only three of the original paragraphs remain. For the most part, the removed paragraphs were either incorporated into CPR 8 as part of the amendments or contain matters for which provision had already been made elsewhere in the CPR. Nevertheless, some of the removed paragraphs which have no direct alternative or replacement provision contained useful practical points which are worth bearing in mind—these points are highlighted below where appropriate.
